Abstract

This study seeks a response on infanticide through analyzes of indigenous cultural manifestations, normative instruments on human rights and indigenous peoples, as well as the conflict between the arguments of cultural relativism and the universalism of human rights. The research had to situate significant milestones, which served as presuppositions for the legitimacy of this individual as a full subject of rights; also sought to give visibility to the evolutionary process of the laws in relation to the Person with disabilities arriving at its Statute, supported by tables and considerations, the research, from this perspective, is a preliminary exploratory study. We seek here to present their limitations to the understanding of social and determinant phenomena, and their conceptions regarding the person with disability and their rights to autonomy and social visibility.
