This article traces a scenario, characterizes and analyzes some legal and academic devices and procedures that seek to open higher education to and with people in situation of refugee in the Brazilian university. Education is considered a fundamental international law, in view of national legislation, international agreements to which Brazil is a signatory, and the action of the Sergio Vieira de Mello Chair of the United Nations High Commissioner (CSVM-ACNUR). Reference is made to the bibliography of the Education area, the theory of migration, the data and guidelines of UNHCR, CONARE, and the Migration Law No. 13,445 / 2017, among others. Interviews with migrants, refugees and academics are used. In Brazil, there are legal, juridical and cultural devices that can be improved in order to benefit the opening of higher education - presential and at distance - with people in situation of refugee.
