The legal protection of climate refugees: an analysis of the normative aspects for the conceptual construction of the category

This article aims to analyze the normative aspects of climate refuge from the perspective of international legal precepts and its insertion in the labyrinths of International Human Rights Law and International Refugee Law. A brief contextualization of the refuge institute will be carried out, as well as the main relevant normative scopes, for the conceptual construction of the new category of climate refugees and the due legal protection to be granted. For this, the deductive-hypothetical method will be used, with a review of bibliographies, to carry out the research. It will be concluded that nothing prevents the guarantee of due protection to climate refugees, in order to protect them in the international scenario in the face of the environmental threats that plague the globe.
