Abstract

The article examines the leniency program of the Brazilian Anti-Corruption Act, especially with regard to art. 16. It starts with the definitions of leniency "agreement" and "program". It then addresses the legal regime of leniency in the Anti-Corruption Act, highlighting its general benefits for collaborating violators. It also points out the shortcomings and failures of the leniency program and brings discussions on how the government sought to solve them, for example, with the frustrated Provisional Measure 703. Finally, it analyses the infra-legal regime of the agreement in order to highlight its advances and situations in which the Public Administration exorbitated its regulatory power.
