Abstract

This article aims to study the limiting boundaries of legal analyzes about facts and grounds of procedural complaint, conducted by the Disciplinary Committee, during the indictment act of the public official, in administrative proceedings. Based on the concept of illicit, it aims at the discussion of the collegiate cognitive powers of the responsible organ for procedural instruction at the time to weigh the occurrence or not of the relevant legal facts to the following process steps. Using the phenomenological method to direct the real purpose and meaning of the indictment act operated by the acting authorities in the disciplinary process and in order to obtain the appropriate form for the inference of infringement evidence, it is concluded that cognition to the case now versed should stick to the objective elements of the stratified concept of misconduct, ignoring, on the other hand, the subjective elements of this concept.
