Abstract

This paper intends to analyze the interrelationships between administrative law and inter­national law of human rights, related to the State liability, based on the Inter-American Court of Human Rights condemnatory sentence rendered against the Brazilian Nation in the case Ximenes Lopes. In order to reach the purpose, brief comments will be made regarding to the State’s non-contrac­tual liability in the Brazilian legal order and the State’s international liability, taking into consideration the specific features related to the Inter-American Court of Human Rights. By the end, it will be verified the necessity to adapt the Brazilian administrative law to the provisions of the international human rights treaties in order to allow the fulfillment of this sentence as well as to increase the beneficial effects of those sentences in the Brazilian legal order.
