Regulatory controversies in contractual relations between institutions of higher education and support foundations

Abstract

The article evidences the regulatory controversies present in the contractual relations between Higher Education Institutions and the Support Foundations, delimiting the object the rendering of accounts of the resources managed by the support entities. For this, we map the state of the art of the legal relationship between both and for the empirical comprehension of the problem, we chose the Federal Universities of São Carlos and São Paulo. As a result, we observed that the researched institutions demand greater flexibility in the execution of resources, preferring the conclusion of contracts rather than agreements, although they contain insufficient and insufficient regulation that differentiates from the consideration of services, allowing loopholes that can cause harm to the treasury and the public interest, reinforcing the relevance of its legal improvement.
