Abstract

This article has the objective to bring light for the reasons that support the possibility of the compensation suit of the public servants for the legislative delay in the edition of necessary law for the annual general review of their maturities. It will be presented doctrinal support, jurisprudential analysis, as well as critical examination of the votes hitherto made in the records of Extraordinary Appeal n. 565.089 São Paulo
