The "Intensive Front for Regulatory and Competition Assessment": a project of exogenous induction of responsive regulation or a source of inter-institutional conflict?

The creation of the "Intensive Front for Regulatory and Competition Assessment" (Fiarc), linked to the Department of Advocacy for Competition and Competitiveness of the Ministry of Economy, adds complexity to the Brazilian institutional scenario. In a context in which the Judiciary, Executive, Regulatory Agencies, Legislative and the Federal Court of Auditors have taken actions that impact the regulatory environment, the performance of Fiarc, by carrying out initiatives aimed at evaluating the quality of regulatory acts regularly issued, may exogenously induce the adoption of regulatory strategies based on persuasion and negotiation. However, it is concluded here that, due to (i) the characteristics of the institutional design of Fiarc and (ii) the difficulties inherent in the operationalization of the responsive regulation tools, the results will depend, to a large extent, on the way in which Fiarc’s instruments are implemented, since there are risks, not negligible, of arising (or strengthening) inter-institutional conflicts.
