This article carries out an analysis of the sentence’s content of the Inter-American Court in which it condemns Brazil for the well-known case of Herzog, which leads to analyses of important questions related to transitional justice, especially the consequences of its consideration as a crime against humanity. In concrete, the legal obstacles that Brazilian courts have planted in order not to investigate the facts and judge those who were responsible are addressed. This work finally finishes with the exposition of the conventionality control demanded by the Court to the courts of different countries and not carried out in this case by the Brazilian courts.
