Abstract

The objective of the present essay is to arouse a reconstruction of the theme, inserted in the roman sale («emptio venditio»), relative to the risk that the object of the sale might accidentally perish - «periculum rei venditae». This problem was analyzed thoroughly, examining the theories of the «abolishment» («Entäuβerungstheorie») by Windscheid, the theory of fault («Verschuldentheorie») by Jhering, the opposed theory («periculum est venditoris») by Haymann and supporters, and the current «communis opinio», based on the theory of custody («custodia») and the theory of the perfect sale («perfecta venditio»).
