Will Personification of Companies be Economic Function?
Keywords:
Personalidade jurídica, Ficção jurídica, Sociedades unipessoais.Abstract
This paper evidences that legal fictions accomplish economic needs and allow the development of larger risk activities, by assigning the concept of legal personality to groups of persons or goods arranged to the consecution of certain socially desirable goals, according to the idea of spread of risk. As this role has been in a secondary plan, Brazilian Civil Code, as long as to conserve the relation between subject and assets, moves away the new European conception of companies: the one man corporation.
