Abstract

This article proposes an analysis of the relationship between the tendencies of liberalization of international trade, on one hand, and environmental protection, on the other hand. It is presented the judgment of a case by the World Trade Organization, regarding the American law, which had forbidden the importation of shrimp that was harvested by vessels not equipped with turtle excluder devices. Composing the analysis, the article brings a description of the case and of the judgment, offering an approach of the legal reasoning of the WTO judgment decision and discussing the consequences of such a decision.
