Were the judges mengerian? The conception of currency in the legal debate

The aim of this paper is to present the concepts about the currency underlying the decisions of the U.S. Supreme Court in the Legal Tender Cases. In the first place, it will be shown the public and private concepts of currency, for later comparison with the Supreme Court’s decisions. Thus, we seek to show how the adoption of one or another conception influenced the decisions on the constitutionality concerning the legislation that introduced legal tender in the United States.
