Abstract

This paper examines legal precedents of the Constitutional Court of Peru on the principles of motivation and due administrative procedure in order to extract the Peruvian Constitutional Court’s understanding on the essential content of such norms. The Hinostroza case (File n. 03891-2011-PA/TC) stands out as the main paradigm. The aim is also (1) to attain insight into the symbolic dimension of Punitive Administrative Law, (2) to establish dialogue between non-existent and apparent motivations, constructions espoused by the Peruvian Constitutional Court, and the lack of motivation and false motivation, constructs embraced by the Council of State of Colombia, and (3) to recall, by the way, the classic French doctrine on the control of the reasons of the administrative act.
