Abstract

This paper discusses, through a critical analysis of the main aspects in relation to ancillary procedures, giving emphasis to the pre-qualification scheme differential treatment of public contracts. Prequalification is the anticipation of the qualification phase, at which qualify persons or property so that they can participate in multiple auctions. In a single moment-qualify if the parties that, if enabled, are able to participate in various public competition relevant to this prequalification. It is an administrative act with the presence of objective criteria of judgment, preceded by due process of law. Therefore, the research conducted brings out possible solutions to the inconsistencies understood against legal texts dealing with the matter.
