The author's study is about the thought of Francisco de Vitória and his contribution for the development of the International Right in the period that preceded the Discoveries. The study still does a critical analysis of the thought of Vitória, demonstrating that the logic of the mercantilist dominance prevailed on the humanitarian character of his thought. Concluding, it analyzes the situation of the Country inside of that panorama, pointing out the violation of rights and the illustration of the brazilian indian, who after 500 years of the discovery has not consolidated, in an effective form, his rights and warranties.
