Abstract

From bibliographic research, the present article introduces the study of the instruments of urban policy - sale of building rights and transfer of the development rights - stablished through the City Statute, applied to the protection of historic heritage, comparatively to legal institutions of heritage rights and inventory. It is presents yet specified the case study of Curitiba, one of the first cities to use such instruments, that served as a model for its inclusion of the City Estatute, as instrument of urban policy to the further brazilian cities. On the conclusion there are identified the issues created with the civil construction market, according with the needed terms for the legal procedures refering on the implementation of transfer of the development rights.
