Space tourism and the regulation of space limits: discussing functionalist and spatialist theories

Abstract

This study aims to discuss the application of functionalist and spatialist theories in the delimitation of space within the context of the private exploitation of space tourism. From a methodological point of view, the research is a literature review, based on the main authors in the field, and a documentary analysis, which relies on international documents, international treaties, and national legislation. The work is divided into three chapters: the first focuses on problematizing the boundaries between airspace and outer space; the second looks at functionalist theory; and the third is dedicated to spatialist theory.

Author Biographies

  • Marcello Cristovão Guedes Virissimo, Universidade da Força Aérea

    Master's student in Aerospace Sciences at the University of the Air Force - UNIFA, he has a degree in Law from the Federal University of Pará (2011) and a degree in Systems and Software Development from the University of Amazônia (2003). He has worked at the National Civil Aviation Agency-ANAC since 2007, where he worked in the Agency's inspection area until 2020, currently working in the Agency's Technical Standards Management. He served as Coordinator of the Regional Civil Aviation Center of Belém from 2010 to 2020, in 2021 he was appointed to the role of Coordinator of the Regional Civil Aviation Center of Brasília-DF (Replacement). He is an Aeronautical Incident Investigator by CENIPA and a licensed lawyer registered with the OAB-PA. He also has training as an Aeronautical Maintenance Mechanic-MMA, with qualifications in the Powerplant and Airframe Groups and has a Certificate of Theoretical Knowledge-CCT for Private Airplane and Helicopter Pilot.
